Terms of use and purchase

This English version is a translation of the Hebrew original. If there is any difference between them, the Hebrew version prevails.

Welcome to DJR LAB. The terms below apply to the use of the website djrlab.com and to the purchase of the courses offered on it. Using the site, leaving your details or purchasing a course constitutes acceptance of these terms. Any gendered wording in these terms is for convenience only, and the terms are intended for all genders.

1. Business details

The site and the courses are operated by:

Hereinafter: "DJR LAB" or "we". Anyone who uses the site or purchases a course is hereinafter called the "student" or the "user".

2. The service

DJR LAB provides courses for learning to trade in the capital markets: group courses in cohorts, taught in live sessions on Zoom or in person, and the Private course (the same course, taught one-on-one with DJR). For each course, the site details the course content, the number of sessions, their length, the start date, the mode of learning and the price. Registered students are given access to a student area on the site, which includes the lesson presentations, practice tasks, review quizzes and a completion certificate.

The courses are for learning purposes only. They are not investment advice, not investment marketing and not portfolio management, and they do not take into account the data and needs of any particular person. Further details on the Disclosure page.

Nothing stated on the site or in the course is a promise of any result, profit or income. Success in trading depends on many factors that are not under our control, and trading involves the risk of financial loss.

3. Registration and terms of participation

• Registration for the courses is for people aged 18 and over. A minor who wishes to register may do so only with the consent of a parent or guardian, and the parent is the one who will make the purchase.
• You must provide correct and complete details. Incorrect details may prevent us from providing the service.
• The number of places in each cohort is limited. Registration is determined by the order in which payment is completed.
• Access to the student area is personal. It may not be transferred to another person, and the login code may not be shared.

4. Price and payment

• The price of each course is shown on the site and on the payment page, in New Israeli Shekels. [to be completed: "Prices include VAT" — or, if the business is an exempt dealer: "The business is an exempt dealer and does not charge VAT"]
• Payment is made by credit card through an external, secure payment provider: [to be completed: name of the payment provider]. Card details are entered only with the payment provider and do not reach the site and are not stored on it.
• Where payment in installments is offered, the number of installments, the amount of each installment and the total amount are shown before payment. Credit card installments are subject to the approval of the credit card company.
• A promo code can be used only if it is valid and only according to its terms. Several benefits cannot be combined unless stated otherwise.
• After payment, a confirmation will be sent to you by email, and a [to be completed: receipt / tax invoice-receipt] will be issued through [to be completed: name of the payment or invoicing service].
• The transaction details document is the payment confirmation sent by email together with these terms, which are always available at djrlab.com/legal/terms.

5. Cancellation of a transaction and refunds

A purchase on the site, or following a phone call or WhatsApp conversation, is a "distance sale transaction" under section 14C of the Consumer Protection Law, 5741-1981. Your rights under the law:

• Cancellation within 14 days: you can cancel the transaction within 14 days from the day of purchase or from the day you received the transaction details document (the payment confirmation), whichever is later.
• Cancellation fee: on such a cancellation, we will refund the amount paid less a cancellation fee of 5% of the price or ₪100, whichever is lower.
• If the course has already started: if sessions have already taken place by the time of cancellation, a proportional part of the price for the sessions that took place up to the delivery of the cancellation notice will also be deducted (according to the number of sessions held out of all the course sessions), whether or not you attended them.
• Senior citizen, person with a disability and new immigrant: a senior citizen (aged 65 or over), a person with a disability or a new immigrant (up to 5 years from the day the status was received) may cancel a transaction made following a conversation between us within 4 months, provided that the course has not yet ended, and subject to presenting an appropriate certificate. The refund will be made in the same manner as set out above.
• Cancellation after 14 days: you can give notice that you are stopping your participation at any time. In such a case, we will refund the proportional part of the price for the sessions that had not yet taken place at the time of the notice, less a cancellation fee of 5% of the price or ₪100, whichever is lower.
• Cancellation due to a defect or non-conformity: if the service was not provided as presented, or the course was cancelled or postponed by us, the payment for whatever was not provided will be refunded in full, without a cancellation fee.

How to cancel: by notice by email [to be completed: email], by WhatsApp or by phone [to be completed: number], or by letter to the business address. Please state your full name, phone number and the course purchased. We will confirm receipt of the notice.

Refund timing: the refund will be made within 14 days of receiving the cancellation notice, to the same means of payment, and the credit card transaction will be cancelled accordingly (including the balance of installments not yet collected). We will give you a copy of the notice cancelling the charge.

Nothing in this section derogates from any right you have under the Consumer Protection Law and the regulations made under it.

6. Dates, missed sessions and changes

• Session dates are published in advance in the student area. Changes to the schedule may occur for justified reasons (for example illness, a holiday or a technical fault). We will give notice of any change as far in advance as possible, and the session will take place on an alternative date.
• If a cohort does not open, or is cancelled by us, you may choose another cohort or a full refund of the amount paid.
• A session you missed for a reason not within our control does not entitle you to a refund. The lesson materials (the presentations, tasks and quizzes) are available in the student area, and you can contact us to catch up on the material.
• In the Private course, session dates are set by coordination. A scheduled session can be changed or cancelled up to the time shown in the student area. A session that was not cancelled by then and that you did not attend will be counted as a session that took place.

7. Recordings

Online sessions are not recorded unless notice of this was given at the start of the session. A recording, if made, will be intended for the students of that cohort only and for learning purposes. Students are prohibited from recording, photographing or distributing sessions, by any means, without written permission from DJR LAB, also in order to protect the privacy of other students.

8. Intellectual property

All rights in the site and in the course materials, including the presentations, texts, videos, recordings, charts, tasks, quizzes, the name DJR LAB and the logo, belong to DJR LAB or to whoever granted it permission to use them. The purchase grants the student a personal, non-exclusive and non-transferable license to use them, for personal learning only. The materials may not be copied, reproduced, distributed, sold, published, publicly displayed or taught to others, in whole or in part, without prior written permission.

9. Conduct in the course and the community

• Respectful discussion must be maintained in the sessions, in the WhatsApp group and on the Discord server. Do not post offensive, misleading or unlawful content.
• Do not post advertisements, investment offers, "signals" or recommendations to buy or sell securities in the community, and do not approach other students with such offers.
• Respect the privacy of other students and do not pass on information about them.
• A serious or repeated breach of these rules may lead to the termination of participation, after a warning where possible. In such a case, the proportional part for the sessions that have not yet taken place will be refunded.

The WhatsApp groups and the Discord server operate on third-party platforms, and the policies of those platforms also apply to them.

10. Liability

• The content on the site and in the course is intended for learning only. Every decision about investing or trading, and its results, is your sole responsibility. DJR LAB will not be liable for any loss or damage arising from trading or investment actions you carried out, even if they were made following things learned in the course.
• Effort is made to keep the information accurate and up to date, but errors may occur. Market data, charts and examples are shown for illustration only.
• The site and the external services we use (such as Zoom, the payment provider, WhatsApp, Discord and TradingView) may experience faults that are not under our control. A session affected by such a fault will be made up at another time.
• Nothing stated here limits any liability that cannot be limited under law.

11. Links to other websites

The site and the course may include links to websites and services of others (for example, charting platforms or brokers). Such a link is not a recommendation of that party, and we are not responsible for its content or service.

12. Privacy

The use of your personal information is described in the Privacy Policy, which forms part of these terms.

13. Changes to the terms

We may update these terms from time to time. The date of the update appears at the bottom of the page. A purchase already made will be governed by the terms that were in force at the time of purchase, unless the change is in the student's favor.

14. Governing law and jurisdiction

These terms are governed solely by the laws of the State of Israel. Exclusive jurisdiction in any matter relating to them is vested in the competent courts in Israel, without derogating from a consumer's right to apply to the competent court according to their place of residence.
